Yes. Beginning July 1, 2024, an entity may not provide home care services in Maine without a Personal Care Agency license issued by the Department of Health and Human Services. The Division of Licensing and Certification accepts initial, renewal, and change applications online.
It is a business entity licensed by Maine DHHS that hires and employs direct-access personnel to provide home care services in a person's permanent or temporary residence. Home care services include assistance with activities of daily living and related tasks.
The package supports a non-medical Personal Care Agency providing permitted home care services such as mobility, transfers, dressing, eating, toileting, bathing, personal hygiene, household tasks, shopping, laundry, cleaning, and medication reminders. Services must remain within the agency's license, staff competency, and applicable professional-scope limits.
No. A Personal Care Agency provides non-medical home care services under 10-144 CMR Chapter 129 and Title 22 §1717. A Home Health Agency or Home Health Care Service provider is separately licensed under Chapter 419 and may furnish nursing or other therapeutic services.
The applicant completes the Maine DHHS online Personal Care Agency license application and submits the documentation and nonrefundable fee required by the application and Chapter 129. A new operator may receive a provisional license for at least three months and no more than twelve months when statutory requirements are met.
The provider should be ready to document ownership, organizational authority, administrator qualifications, personnel, mandatory training and competency, client rights, assessments and service plans, scheduling and service records, complaints, incidents, emergency practices, background screening, quality measures, business records, confidentiality, and regulatory access to records.
Yes. A Personal Care Agency must conduct comprehensive background checks for direct-access personnel and their immediate supervisors. Before hiring specified workers or supervisors, the agency must also check the Maine Registry of Certified Nursing Assistants and Direct Care Workers for disqualifying notations.
The provider must ensure workers and supervisors meet Chapter 129 personnel qualifications and mandatory minimum training requirements. Personnel files should document orientation, training, competency, supervision, registry review, background checks, client rights, emergency practices, infection control, service documentation, and continuing education when required.
Maine may issue provisional, full, or conditional licenses. A provisional license may run from three to twelve months; a full license may run for up to twenty-four months; and a conditional license identifies required corrections and a compliance timeline.
