Yes. Maine requires every Home Health Agency and Home Health Care Service provider to hold a state license. A Medicare-certified Home Health Agency is state licensed and federally certified; a Home Health Care Service provider is state licensed only.
This package is designed for a Maine Home Health Agency, including an agency planning to pursue Medicare certification. It is not a Personal Care Agency, hospice, residential care provider, or personal-care-only package.
Maine law defines a home health care provider as a business entity providing acute, restorative, rehabilitative, maintenance, preventive, or health-promotion services through professional nursing or another therapeutic service in a client's residence. The definition includes specified therapies, aides, medical social work, nutrition, and personal care services, subject to statutory exclusions.
The applicant establishes its business, ownership, location, program leadership, policies, insurance, staffing, and operating systems, then submits the Maine DHHS Division of Licensing and Certification application, required documentation, and fee. An agency pursuing Medicare also completes CMS-855A or PECOS enrollment and federal certification requirements.
The agency should confirm ownership, service area, program-director and clinical-leadership qualifications, operational location, insurance, personnel, policies, background screening, emergency preparedness, clinical records, quality systems, and all Maine DHHS and CMS materials. The applicant should verify current pre-survey and census expectations directly with the Division of Licensing and Certification.
No. Medicare billing requires successful enrollment, certification, an applicable state-agency or approved accreditation survey, and continuing compliance with 42 CFR Part 484. Reimbursement is not retroactive to services furnished before the effective certification date.
The agency should have Medicare-aligned governance, administrator and clinical-supervision systems, personnel qualifications, patient rights, comprehensive assessments, plans of care, quality assessment and performance improvement, infection control, emergency preparedness, clinical records, complaint handling, and service-delivery documentation.
The agency must provide skilled nursing and at least one additional qualifying therapeutic or home health aide service, directly or under permissible arrangements, and must have qualified staff and systems to comply with the Medicare Conditions of Participation.
The agency needs a legitimate operational location that supports administration, supervision, secure records, communication, patient services, and survey access. Applicants should verify zoning, lease, accessibility, business-registration, and local requirements before committing to a site.
The Maine Department of Health and Human Services, Division of Licensing and Certification, licenses Home Health Agencies and Home Health Care Services and performs applicable federal certification surveys. CMS establishes Medicare requirements, and a Medicare applicant follows the applicable state-agency or CMS-approved accreditation survey pathway.
Not necessarily for state licensure. A CMS-approved accrediting organization may provide a deemed-status Medicare survey pathway, while Maine DHHS remains the state licensing authority. Applicants should verify the pathway with Maine DHHS, CMS, the accreditor, and payers.
