Oklahoma Home Health Agency Complete Startup Package

This package supports the Oklahoma Home Care Agency license for skilled medical home health services under the Home Care Act and OAC Title 310, Chapter 662.

It covers the skilled agency application, policies, personnel materials, clinical documents, and operating forms described in the package. Federal certification is separate.

The Oklahoma State Department of Health (OSDH), Home Services Division, licenses and surveys Home Care Agencies. The principal requirements are the Home Care Act, 63 O.S. § 1-1960 et seq., and OAC Title 310, Chapter 662.

Oklahoma's Home Care Agency license covers the services selected in the application, including personal care or skilled care. The service scope determines the staffing, supervision, and care requirements.

The skilled agency may offer nursing, physical therapy, occupational therapy, speech therapy, respiratory therapy, medical social services, and home health aide or personal care services, as appropriate to its application and staffing.

Oklahoma's state licensing rules govern the services actually offered. The agency must maintain qualified staff, necessary supervision, and care plans for each service; the state-licensed package is the path that cannot bill Medicare.

The initial license and application fee is $1,000. The annual renewal fee is $500. These amounts apply to the Home Care Agency license used for the personal care and state-licensed skilled startup paths.

ODH Form 757 also lists a $25 annual branch renewal fee. The form explains prorated renewal fees when an initial license is aligned with the July 31 renewal date. State fees are nonrefundable and separate from our startup package.

Yes. The agency must operate from a place of business physically located in Oklahoma and accessible to the public. ODH Form 757 specifically states that an agency cannot be located in a home.

Provide the physical address, office hours, contact details, and an after-hours telephone number. Staff providing services must be supervised from the agency location, and required records must be available for review.

Yes. The governing body appoints a qualified administrator who must hold the required OSDH home care administrator certification. This certification is separate from the agency's license.

The administrator directs agency operations, employs qualified staff, oversees training and evaluations, and ensures agency practices follow its written policies. Proof of current administrator certification must be posted conspicuously.

An agency providing skilled care must employ a physician or qualified supervising registered nurse. A physician or qualified RN alternate must be designated in writing to cover the supervising nurse's absence.

Clinical supervision and certified agency administration are distinct responsibilities. Provide the required credentials for both roles with the application.

Skilled nursing is furnished by, or under the supervision of, a registered nurse and follows the ordering practitioner's orders. The RN evaluates needs, develops and revises the care plan, coordinates services, provides skilled care, and supervises and teaches.

An LPN provides services within the nurse's lawful scope, agency policies, and required supervision. The agency maintains current license verification and documentation of qualifications.

Oklahoma requires home health aides providing personal care to be certified and listed on the OSDH Home Health Aide Registry, unless the worker is a licensed health professional meeting the rule's exception.

Verify the worker's credentials, registry status, screening, orientation, and competency before assignment. A job title alone does not establish eligibility to provide hands-on personal care.

Skilled services require an order from a physician or authorized non-physician practitioner. The agency sends the order to the practitioner within 10 days for signature and timely return.

The admission plan addresses diagnoses, services, equipment, visit frequency or hours, medications, treatments, functional limits, nutrition, safety, and other patient needs. Clinical records receive continuing review for each 62-day period to assess the plan and continued care.

When home health aide or personal care services accompany a skilled service, an RN makes a supervisory home visit at least every 60 days, and more often if the client's condition requires.

When the only skilled service is therapy and aide care extends that therapy, a qualified therapist may make the required visit instead. Appropriate supervision must be available whenever services are provided.

Yes. Written agreements identify the services, coordination and supervision, care-plan responsibilities, scheduling, and submission of clinical notes. The primary agency remains responsible for coordinating care and maintaining the client record.

Verify contractors' current professional licenses or certifications and retain that verification. Contracted services are included in the agency's quality assessment program.

Yes. Oklahoma uses OK-SCREEN for covered applicant screening, fingerprinting authorization, and employment eligibility determinations. The agency must complete the required screening and registry checks for the positions it fills.

Keep eligibility and credential verification in personnel records. Supportive home assistants also have specific criminal-history and registry restrictions under the Home Care Act.

The agency rules specify liability insurance of at least $100,000 per occurrence and $300,000 aggregate. The application also requires workers' compensation verification.

Provide evidence of financial solvency, such as a bank statement, letter of credit, or line of credit in the required operating-entity or DBA name. Maintain an annual operating budget and sufficient resources to provide the planned services.

Yes. Each Home Care Agency needs an ongoing quality assessment and improvement program approved by its governing body. It covers services provided directly and by contract and includes client satisfaction surveys and sample clinical-record reviews.

Document assessments and improvement recommendations and report them to the administrator and governing body at least every three months. Written policies must support the services offered, personnel, client care, infection control, safety, emergencies, and records.

OSDH's application guidance places a complete application in the queue for an initial onsite licensure survey. The agency must be ready for business, with its required staff, policies, records, and operating arrangements available for review.

The survey determines whether the agency meets the minimum licensing requirements. Providing home care services before receiving the required license is not permitted.

An initial license is issued for 12 months. Renewal licenses are aligned to July 31, with a prorated renewal when necessary. OSDH's renewal letter instructs agencies to submit the completed renewal materials and fee by June 30.

Renewal includes current administrator certification, supervising-professional verification, insurance, business information, and the applicable fee.

No. This state-licensed agency type cannot bill Medicare. Medicare participation requires separate federal enrollment and certification. Those steps are not included in this state-licensure startup package.

This skilled agency model provides medical care and personal care with Insurance, VA, Private Pay, and Workers Compensation reimbursement arrangements.

The agency must meet each payer's participation, authorization, covered-service, and billing requirements. Private-pay services use the agency's client payment agreement. The state license does not itself create a payer contract.
