Texas Licensed Home Health Agency Complete Startup Package

This package is designed for a Texas Home and Community Support Services Agency licensed in the Licensed Home Health Services category, commonly referred to as an HCSSA-LHHS agency.

It is for state-licensed home health services without Medicare certification. It does not include the Licensed and Certified Home Health Services category, hospice, home dialysis, or Personal Assistance Services unless those services are separately added.

An LHHS agency generally must designate a qualified administrator, alternate administrator, supervising nurse, and alternate supervising nurse. These individuals must meet the applicable qualification and Presurvey CBT requirements.

Texas provides a limited exception to the supervising-nurse requirement when an LHHS agency offers only physical therapy, occupational therapy, speech therapy, respiratory therapy, medical social services, or nutritional counseling. In that situation, an appropriately qualified licensed professional must supervise the services.

The agency must maintain a designated place of business. A separate commercial office is not necessarily required, and a residence may be used when it is the agency's actual place of business and all applicable requirements are met.

The location must satisfy requirements concerning operating hours, record accessibility, surveyor access, contact information, and display of the license after it is issued. Applicants should also verify local zoning, lease, deed-restriction, and homeowners-association requirements.

Texas HHSC states that the licensing unit may take up to 45 days to process a thoroughly complete application. The total startup process may take longer.

After the initial license is issued, the agency generally must admit at least one client, initiate services, and request its initial survey no later than six months after the license's effective date, unless an applicable accreditation exemption applies.

A properly licensed LHHS agency may provide the services authorized by its license and supported by appropriately qualified personnel. Depending on the agency's service plan, these may include:

• Nursing services, including blood-pressure monitoring and diabetes treatment.
• Physical, occupational, speech, or respiratory therapy.
• Medical social services.
• Intravenous therapy.
• Nutritional counseling.
• Medical equipment and supplies, excluding drugs and medicines.
• Services provided by qualified unlicensed personnel under the delegation or supervision of a licensed health professional.
• Qualified home health aide services.

Service-specific assessment, plan-of-care, delegation, supervision, competency, and documentation requirements must be followed.

No. The Licensed Home Health Services category is a Texas state license and does not by itself authorize the agency to bill Medicare.

An agency seeking Medicare certification must pursue the appropriate Licensed and Certified Home Health Services category and complete the separate federal certification and enrollment process.

An LHHS-only license does not independently authorize Medicare-certified home health, hospice, or home dialysis services. It also does not add the Personal Assistance Services category unless PAS is listed on the agency's license.

No. Home Health Forms provides startup guidance, customized documents, and application-preparation assistance. The Texas Health and Human Services Commission makes all licensing decisions.

The applicant remains responsible for providing complete and truthful information, meeting personnel and office requirements, paying state fees, completing required training, responding to state requests, and maintaining compliance with applicable laws and regulations.

Licensing approval and processing times cannot be guaranteed.

Website development, domain registration, printing, shipping, and other package components may have separate production timelines.

Cancellation and refund eligibility depends on the work already completed, customized materials produced, digital products delivered, third-party expenses paid, printing ordered, and other services already performed.
