The Personal Care Agency license under R432-725 covers the licensed non-medical personal care agency model. Select the personal care category in the health-facility licensing process and prepare policies for the services the agency will actually provide.
For July 1, 2026 through June 30, 2027, the initial Utah Personal Care Agency main-office fees total $3,243.54: $743.83 base fee, $1,430.45 agency fee, and $1,069.26 new-provider fee. Initial DACS setup is an additional $100; fingerprinting and other applicable charges are separate. Government fees are not included in our package.
The administrator must be at least 21 years old and have at least one year of managerial or supervisory experience. Designate a qualified alternate in writing and arrange the availability required during agency operating hours.
The Utah checklist identifies a licensed nurse or a certified nursing assistant with at least two years of experience in an in-home setting for the supervisor role. Document the person's qualifications and assigned supervisory responsibilities.
R432-725 calls for an on-site evaluation in the client's home at least every six months. Document the review of services and any necessary changes to the care arrangements.
Personal care aides must be at least 18 years old and qualified for assigned duties. The agency provides orientation and at least six hours of in-service training each year, with training and competency records retained in the personnel file.
The Direct Access Clearance System is Utah's background clearance process for covered workers. Establish agency access and complete the required checks and eligibility steps before an employee has access to clients as required by the applicable screening rules.
Prepare the online application, ownership and organizational information, the applicable business license, program description, qualified administrator and staff information, and the R432-725 policy checklist with supporting documents. Fees and background-system setup are separate business costs.
Only assistance permitted by the personal care rule, the written plan, and the worker's qualifications should be assigned. Clearly distinguish permitted assistance with self-administration from nursing assessment or medication administration that requires professional authority.
The 2026–2027 schedule lists $371.92 for an additional branch. The agency must also meet the branch approval and operating requirements; paying the fee alone does not authorize a new location.
Establish written emergency contacts, staff escalation, backup coverage, weather and travel procedures, and instructions for clients when a scheduled visit cannot occur. For an immediate medical emergency, staff should activate emergency services. Keep the response appropriate to the Utah services your agency is authorized to provide.
Provide a clear contact for concerns, record each complaint, assign follow-up, document the response, and review patterns that call for changes. Preserve client confidentiality and follow applicable abuse, neglect, and incident-reporting requirements.
